Abstract
The development of the system of mediation in pertaining civil action to criminal procedure has close relations to the light-punishment movement of criminal justice in recent years.The mediation agreement reached between the victim and the defendant,which means that the victim has forgiven the contrite defendant and the dangerous consequence of the crime mitigated,will lead to lenient punishments of cirme.Because the mediation in pertaining civil action to criminal procedure has many differences from the mediation in general civil action,mediation rules of procedure of it should be instituted in particular,which includes the scope of application,parties rights to information,authorities of mediator and the enforcement of the mediation agreement.
