Analysis of the Influence of the Civil Appeal System upon the Civil Procuratorial Supervision System

The civil appeal and procuratorial supervision systems are closely related to each other.The civil appeal system can greatly influence the position,scope,content,scale,and attitude of the civil pocuratorial supervision system.At present,due to the fact that legislation has never properly resolved the relations between the position of civil procuratorial supervision,its program design and the components of the whole system,the specific operating procedure of civil procuratorial supervision remains ambiguous,resulting in problems and mistakes in practice;for example,the contents of the legislated civil appeal system has been taken as the benchmark for the practice of civil procuratorial supervision.It is,therefore,suggested that retrospection and reform should be done by taking the civil appeal and procuratorial supervision systems as a holistic and inter-related matrix,so that each individual system can respectively play its own role and the expected value of the civil pocuratorial supervision system can be implemented from the legislative point of view.
