Thoughts on Unconstitutional Legislation Right of Criminal Law Amendments

Abstract
Comparison with the one-way Penal Code,Criminal Law amendment is a better legislation model.However,the NPC Standing Committee as legislator of Criminal Law amendment,which the action of changing Criminal Code by means of criminal law amendment could lead to suspicion of unconstitutional.Criminal law amendment,as an additional model of legislation,Criminal law amendment can be passed by NPC Standing Committee if it if it amends or supplements to provision the Criminal Code,can be passed by NPC Standing Committee.However,if it is to add new provisions,it should be formulated and promulgated by the National People's Congress if it is to add new provisions.
