Abstract

These years,the medical malpractice has appeared largely and become a focus in the society.But the legislation in our country is relatively behind and not unified.So it has caused many difficulties in the disposal of these cases.In order to defend the rights and interests of the two parties,adjust the relationship between them,especially protect the benefit of the victims,this treatise will study some legal problem in medical malpractice and put forward correlative judiciary proposal.
