Abstract
After Nanjing Provisional Government was established in 1912, it issued a series of decrees which were helpful to the promotion of democratic politics, capitalism and social reforms. The most important one was The Provisional Constitution of the Republic of China. This article discusses its constitutional principle, basic human rights, its principle of rule by law and principle of power restraint as well as its great significance in the history of legal system building in modern China.
