On Identification of the Public Interest in Administrative Requisition

The public interest provides the legitimate basis for the administrative behavior such as administrative requisition.The concept of the public interest,however,has not been interpreted explicitly and specially in Chinese laws and administrative codes.In principle,the meaning of the public interest is indefinite,but we can make use of various interpretations such as the common interest,the public interest and the public reason,and make the legal essential and formal criterion for judging the public interest,thereby restrict administrative requisition effectively.
