Legal countermeasures of water pollution in rural areas in China

The status in quo and causes of water pollution in rural areas in China were analyzed. The water pollution was classified into the following types: the one caused by farmers′ production and living styles, and the one aroused by urban pollution accompanying with enterprises in towns and villages. The causes for the water pollution in rural areas lay in the binary social structure of urban and rural areas in China, and it was also the cause for the environmental problems in rural areas. Simultaneously, the legal scarcity for water pollution mitigation in rural areas was analyzed: the backward legal concept, the imperfect legal system and the scarce water pollution mitigation system in accordance with the rural characteristics existed in the current laws for water pollution mitigation in China, and in general, it was short of the laws for water pollution mitigation in agreement with the rural characteristics. The legal countermeasures were put forward: the innovation of legal concept of water pollution mitigation, the improvement of legal system of water pollution mitigation, the strengthening of water pollution system in rural areas, and the covering of water pollution in rural areas into the legal orbit.
