The Dilemma and Outlet of Interactive Relationship between Criminal Law and Criminal Procedure Law

The relationship between criminal law and criminal procedure law is not considered enough whether in the theoretical research or the Chinese legislation and practice.Criminal law and criminal procedure law are estranged from each other,the interaction between each other is not obvious and a situation of separation,split and fault is presented.Criminal law and criminal procedure law is a harmonious and uniform organic whole.They are tied together by crime,share a common value orientation,both are subject to criminal policy guidance and coexisted in the history.Therefore,it is necessary to deepen the cognition of the relationship between the criminal law and criminal procedure law,to set up idea of criminal science integration,to pay attention to the integrity of legislation,to strengthen the amalgamation of practices,and to carry out crossover research.These methods will achieve the two-way benign interaction and coordination of development between criminal law and criminal procedure law.
