Abstract

Students' injury in elementary and secondary schools is treated a complex and confused area.This paper focuses on how to deal with injury disputes among parties.The main ideas are as such:school is not students' guardian but has some guardianship by parental appointment.A school authority comes under a duty to ensure that reasonable care is taken for students attending the school.In resolving students' injury disputes,not only fault liability but also liability without fault or equitable liability is applied.
