A right to environment is regarded as a new type of human right based on three aspects.The produce and formulation of an environmental right were come into being by the nature of human right.The contents of environmental right could not be covered by the typical property right and personal right,so environmental right is of the nature of human right indubitably.A right to environment included by the national constitution will provide stable and useful support to ensure the environmental right of the citizens.
