The Reconstruction of Environmental Right Theory

Environmental right issue is the key question of environmental law study.However,in the course of discussing the question of environmental right in the past,two kinds of awkwardness appeared: First,the melting fuzzily of environmental right;secondly,environmental right is unable to become the independent right.To these two kinds of predicaments,Professor Zhou Xunfang have made the answer which belongs to him,wand proposes specifying environmental right,constructing the environmental legal system of the independence.Of these two kinds of efforts,one makes environmental right become the real right,the second,makes the environmental law really become the independent law department,and that kind of view which thinks that environmental right includes development and utilization right to resources on the basis of surviving is worth discussing.
