Abstract
Right of silence, as an important right of the criminal suspect or defendant in criminal procedure, is regarded as a significant embodiment of guarantee of human rights. However, there is not yet condition to stipulate right of silence in China at present, but the criminal procedure system can avoid the malpractice brought about by not stipulating right of silence.
