Main Legal Barriers on Establishment of the System of Constitutionality Review in China

Abstract

In order to implement the Constitution, the system of constitutionality Review should he set up accordingly. However in PR china, the agency in charge of reviewing on constitutionality hasn' t be founded yet. And the agency which enforces law and the agency which construes the Constitution and law are not the same one. Besides there's a lack of means to start reviewing on constitutionality. So up to now, the system of constitutionality review has n' t been established in PR China and we' 11 have a long and tough way to go to establish and perfect this system.
