Abstract

The rationale of the jural principlenulla poena sine lege(on crime without a law)is originated from western jurisprudents' ideology on democracy and leglity.The essence of the principle is the int rinsic demand of democracy and legality for mens legis(legal mind).The socialist nature of China determines the establishmer of the jural principlenulla poena sine lege(no crime without a law)in this country .Although the history of legal system of the People' s Republic of China shows that the serring up of the jural principlenulla poena sine lege(no crime without a law)is not a smooth process,it will be formally established in China eventually.
