The constitution of crime theory plays a very important role in the history of criminal law.It indicated the birth of modern criminal law.Since then crime was bond to criminal law rules,and the principle of a legally prescribed punishment for a specified crime came into practice.The importance of the constitution of crime theory,which is the foundation of criminal law,lies on the basis for the justification of the criminal law system.Reviewing the history of criminal law,moved from classical criminal system to neoclassical criminal system,teleologism criminal system,and teleologism rationalism criminal system,the constitution of crime theory has paved its way from the mere basis of facts to norms.Therefore,making clear definitions of the facts and norms of the constitution of crime theory are essential in modern criminal law.
