On the Establishment of Procedural Sanction of the Criminal Actions

Punishing offence,safeguarding human rights and keeping social order are the objective of criminal pro-cedure.The realization of criminal procedure action’s objective relies on the judicial agency,litigant and partici-pant’s obedience with all of the criminal procedural norms.But there exists a great gap between the prescription ofcriminal procedure lawof our country and the judicial reality.The criminal procedural norms are violated seriouslyin China;the absence of the criminal procedural sanction mechanism is an important reason for it.At present,it isnecessary and feasible to establish procedural sanction in China.
