The Constraint and Supervision of Power in the Criminal Procedure

Abstract

The power in the criminal procedure is easy to be expanded,eroded and out of control.If it is misused,not only the personal freedom and property of people can be constrained,but also the human life can be deprived.Therefore,it is necessary to constrain and supervise the power in the criminal procedure.Because of the shortcoming in the procedure in our country at present,we should rethink the human nature,rebuild a reasonable criminal procedure structure,supervise the power,distribute the power reasonably,constrain the power with power,strengthen the protection of human rights,and limit the power with rights.
