On the Difficulty in Intellectual Property Guaranteeing Financing and Countermeasure

Intellectual property has value,use value and transferability which can be used as guarantee to get loan.Such elements cause the inherent risks in intellectual property finance as the possession of secured financing cannot be transferred,variable value and the possibility of infringement of intellectual property.China's current laws and institutions cannot eliminate such risks in a high degree,and therefore it is difficult to get loan by using intellectual property as guarantee.After analyzing three financing guarantee patterns including intellectual property,income from intellectual property and the credit guarantee of the third party,the author believes that it is desirable to utilize the government guarantee for corporate finance and corporate intellectual property strategy of counter-guarantee.
