Abstract

The separation of powers existed in earlier human society.The development of Bourgeois revolutionary theories and practices promoted the separation of legislative power,executive power and jurisdiction.Compared with the other two,the independence and authority of jurisdiction is weaker.In China,jurisdiction is the weakest among the three powers.The construction of an independent jurisdiction will be a long and painstaking process.
