Can Tort Law be Independent of Debt Law after All?——Written after Law of Tort Liability has been Promulgated

Abstract

It's important to study whether tort law can be independent of debt law after Law of Tort Liability has been promulgated,considering the codification of civil law is being conducted.Tort can be divided into two kinds: tort behavior and tort incident from the perspective of the definition of tort conception.Tort came into being before debt from the view point of legal history,from the perspective of logical structure of civil law standard,which consists of presumption and treatment.protective legal relation and adjusting legal relation Both belong to the treatment part of a civil law norm.As a result,tort law cannot be independent of debt law.
