Abstract
The article 4 clause two of tort liability law establishes tort liability priority principle,which has great significance to the maintenance of private rights.Tort liability priority essentially related to the competing issues among tort liability,administrative liability and criminal liability.The main reasons of establishing tort liability priority include: reflect the priority of private rights,realize the values of law,and maintain the market economic order and transaction security.
