Abstract

The system on third party beneficiary contracts is a necessary breakthrough for doctrine of the privity of contracts, but it hasn't been established in China. This article is to discuss the position, value and restrictions by country of the parties' will in third party beneficiary contract system; moreover, to provide legislative reference to our establishment of the system .
