With the coming of information times,in Electronic commerce or other computer criminal cases,the evidential price and function of data message becomes more and more important.Electronic evidence is a kind of electronic information which lies in computer hardware or software magnetic medium in form of data message.The character of electronic evidence is different from that of traditional evidence.In respect to its adoptability, Electronic evidence is different from written evidence and video-audio material.There is no difference between the original and the copy of electronic evidence.Therefore,It should be sorted as a new kind of evidences.We can ensure from three legal aspects that the evidence value of electronic evidence exists or not.Therefore, Electronic evidence should be emphasized in evidence legislation.
