Abstract

As a legal reason of impunity,force majeure is a verdict in the civil contract theory.But the rule of dealing with force majeure should be different between equipment contract and civil contract.The purpose of the article is to analyze the composition and extent of the force majeure,and compare the legal consequence of equipment contract and civil contract,and arrive at a conclusion that the force majeure legal system should be established by the legislature.
