On the Reservations to the Dispute-settlement Clauses in Treaties Participated by China and Its Perfections

Abstract

So far,China has participated in 26 treaties in which China has made reservations to the dispute-settlement clauses.The reasons,the content of the reservations and the authority to make the reservations all have certain characteristics.However there are some limitations of the formulation of China's reservations to treaties with this respect.With the dramatically changing of the ICJ and PCA,and with Guide to Reservations having laid important rules,it's very necessary for China to change the attitude and make perfections.As far as the Improvement Measures are concerned,first,China should be very careful to make reservation stothed ispute-settleme clauses afterwards;Second,China should actively develop legal rules for treaty reservations to provide a legal basis;Third,China should make an explanation to the reasons of the reservations to treaties;Fourth,China should withdraw the reservations to the advisory jurisdictions of the ICJ;Lastly,China should take different measures as to litigation jurisdiction and the jurisdiction of the PCA according to different circumstances.
