On the Protection and Guarantee of People′s Housing Right from the Perspective of Constitution

In recent years,as an important issue of the people′s livelihood,housing problem has increasingly become the main concern either by government or public.Housing is not merely an issue of living quarter or personal possession,but is more closely linked to social justice and human dignity.The housing right as a part of human rights has been universally acknowledged and explicitly prescribed by the international or regional documents of human rights.The housing right is a basic human right from the perspective of constitutionalism,and its corresponding subject of duty is the state.Specifically,the state has the obligation to respect,protect,promote and fulfill people′s housing rights.Protecting the right to housing is an indispensible subject in the constitutionalism construction of our country,which requires the efforts to improve present system from three aspects: legislation,policy and justice,so that people′s basic housing right can be substantially guaranteed.
