The Relation Between the Party's Criminal Policy and Criminal Law in China

Abstract

Criminal law system under the Chinese Communist Party is one of the features in Chinese criminal law system. This leadership is done mainly by criminal policy. Before Criminal Law, the Party's criminal policy owned the function of the Criminal Law. After Criminal Law, the Party's criminal policy still directs, surveys, revises and improves the Criminal Law and has guiding significance in both criminal legislation and criminal justice. Legislation and Justice under the Party's leadership is a political principle of Criminal law system in China.
