The Study on Engineering Assured Guarantee Modes based on the Theory of Restrain Harmonious

Establishing and implementing engineering assured guarantee system in China is needs not only to use international practice for reference,but it also to explore engineering assured guarantee mode suitable for Chinese conditions.We analyze the four types of international typical guarantee mode,namely the high amount of conditional guarantee mode,low amount of unconditional guarantee mode,trust fund mode and trade guarantee mode.The survey found that there is the mainstream of the models for engineering guarantee with low forehead unconditionally guarantee mainly,high forehead conditional complementarily at present.Based on the core thought with the theory of restrain harmonious,by the standards of fairness,real,be good for the contract fully perform and effective.We should set new engineering guarantee mode: under the government regulation,moderate forehead of conditional guarantee and trade guarantee coexist.We point out the five factors implementing new engineering guarantee mode:break the traditional mode of thinking bound,make the construction project guarantee security law applicably,strengthen guarantee agencies' functions construction,establish and perfect the government regulatory functions,establish scientific project guarantee mechanism.
