Abstract

Under most circumstances,Environmental Right is still a vague term.As a kind of legal right,it is until today expressed as Mankind's in Constitutional laws,domestic and international law.In the sense of constitutional law,environmental is treated as a kind of new human right,in the sense of international law,it is Mankind's right,in the sense of domestic law,it is the citizen's right.State's environmental right is in fact the sovereignty in dealing with domestic issues,and the so-called enterprise's environmental right is essentially the property belonging to the civil and commercial law other than the right.
