On the Basic Characteristics and Development Trend of the Personal Law of the Physical Person

Abstract

The personal law of the physical person is a country's law which lastingly governs the physical person's legal relationship with the country. Its three basic characteristics include:(1) it has lasting force on the physical person in relation to time;(2) it concerns the physical persons' close connection with the territory;(3) it concerns the physical persons' legal status. The development of the contemporary personal law features two tendencies: (1) the principle of municipal law is weakening while the principle of domicile law is being strengthened; (2) the influence of the principle of the closest connection on the traditional personal law of physical persons deepens in depth and scope. These development trends have in practice exerted increasing influence on our country's personal law of the physical persons.
