Abstract
The study model of state and society has a historical basis of western meaning,scholar handing down and heritage as well as analytical dimension.The paradigm is used in two pragmatic morphologies including civil society and local society.The two kinds of morphologies express two kinds of particular social cultural character generated from theories.To make use of the paradigm as a analysis frame to study the Chinese folk law,the cultural individuality of Chinese society should not be ignored and the normality of the paradigm should be focused on.Therefore,based on the Chinese circumstance,we must define the application limitation of the state-society paradigm.The descriptive sense of the paradigm for studying folk law is that we expand our study perspective to everyday life,and the normative sense of the paradigm is that we treat the contractive dimension of folk law as the selection standard for ruling the local resources by law.
