Along with China's economic and social development,a lot of disputes relevant national and social and public interests gradually appeared in the social practice.Civil public interest litigation,as a judicial relief measures against illegal behaviors that harm social welfare,maintenance and public interests,has been known for the society.Based on the background of relevant civil litigation regulation deficient in current legislative layer,having a discussion from the litigable scope,legislation mode,style,concrete procedure system design etc basic aspects to make theoretical preparations for improving our legal system of civil litigation,constructing the civil litigation system,is not only an urgent need to comply with national conditions and the public opinion,but also an inevitable requirement to build a socialist country under the rule of law.
