In order to explore the key problem of the legality of administrative accountability system,the article suggests that whose concrete category should be the legality of the political responsibility,disciplinary responsibility and moral responsibility of administrative subject and public servant,the legal liability need to be only perfected further on current available basis.The legality of administrative accountability system should be placed emphasis on distinguishing the administrative responsibility and competence of administrative subject and public servant in legislation.Appropriate path of the legality of administrative accountability system should perfect the administrative institution law,the legal system of superintend administration concerned and public servant law and etc..
