Abstract
It is a new and effective practice in the study of labor criminal law based on the perspective of rule of labor law.This can help labor criminal law to be a part of modern criminal law,exhibit its function,make clear its model of crime and punishment,and discover its nature.In perspective of rule of labor law,the study of labor criminal law aims not only to reconsider the boundary and model that criminal law gets involved in industrial relationship and the reason that labor criminal law emerges,but also to through light on the creation,function,and structure of crime and liability,to discover the intrinsic theory of the creation of labor criminal law in China.
