The Sense of Special Tort Liability ——The Extent of the High-Risk Operation

Abstract

The thesis, based on the analysis of the two substantial cases, reveals the state of application of special tort action in the judicial practice. As such, the author believes that it is not enough for the person concerned to recognize his or her tort. Furthermore, such cases caused are quite different from general civil liability: especially in view of extent of the doctrine of liability fixation civil liability.
