The Realization of the Value of Mining-rights Based upon State Ownership

Mineral resources belong to all countries in China,However,in fact,laws and policies concerning mineral exploration positioned mining rights as a usufruct;considering the exhaustion of the mineral resources,the right to use mining rights has turned into an ownership on mineral resources.The state ownership of the mineral resources is far from being realized,and this situation has directly resulted in the development benefits of mineral resources not evenly distributed and has restrained the sustainable development of mining industry.So it is imperatives to determine the state ownership value of minerals,perfect system and ensure the sustained support of mineral development for economy and society by the top-level design.This paper offers some specific methods for realizing the state ownership of mining rights and promoting the sustainable development of mining exploration,these include: improving tax policy,and evaluation of mining rights;implementing environmental protection;and setting up framework of interest distribution.
