Abstract

Compared with the lien legislation of other countries and regions, it is clear that there are some defects of Chinese law on lien including simpleness and unreasonableness etc. The author advises that the bona fide acquisition of lien and emergency Lien should be introduced and the contact between chattel possession and debt should be stipulated as a legal requirement.
