Abstract
The lessee's preemptive right over leased buildings is a legal right provided by the PRC Contract Law. When the landlord sel須 the leased buildings, the lessee can exercise its preemptive right with the same conditions provided by the contract between the landlord and the third person. How a lessee may exercise its preemptive right should be interpreted in accordance with the current laws. Once a lessee exercises its preemptive right, a sales contract should be created between the landlord and the lessee. However, the lessee should not obtain the title over the building from the sales contract directly.
