On the Guarantee of the Status and Rights of the Victim in Criminal Procedure Law

Aiming at the existing limitations in the legal protection of victims' status and rights guaranteed by Criminal Procedure Law in China, and confronting the principle of justice and impartiality and the lowest standard in criminal judicial judgment, this paper elaborates on the following points:safeguarding victims' power to prosecute, ensuring their power to participate in prosecution, guaranteeing their right to gain practical compensation, propriety and reasonably balancing the rights of the victims and defendants, so as to protect the victims and realize the full participation of victims in the process of prosecution, and perfect the legal protection of the victims' rights.
