The Punitive Damages System

Abstract

Although punitive damages system has functions such as compensation, punishment and prevention, it has defects . Four methods are used to complete it by international society. They are: (1) higher certificating standard; (2) separating principle; (3) limited maximum amount; and(4) taxes levying. Due to some problems in the practice of punitive damages , the article analyses the application of the punitive damages system in China.
