“Right of Life”,“Right of Life and Security”, “Right of Life and Health”: What shall be Adopted in Constitution——Perspective of Philosophy of Life in “SARS”

Traditional right of life shall be improved with respect to concepts and notions in time and then it can be adopted into the constitution. “Right of life and security” is more active and popular than “right of life”, is closer to the “right of existence” held by Chinese government. Only the “right of life and security” is helpful not only to correct the phenomenon of belittling citizens' life in the tradition and the actual reality but also to strengthen the awareness of responsibility of a state and society to rescue life jeopardy and make it consistent with the right of physical assistance in the constitution. It is improper to adopt the “right of life and health” in the constitution, because they are two different kinds of rights and there are no syncretic characters. What's more, the item of rights of the constitution has shown the right to health.
