The Indentification of Sprit Indemnity Remedy and The Completion of Relative Legislation

The theory field in our country has many disputes or the spirit indemnities, and there is no clear and definite provision in the legislation. So it has resulted in the insufficient protecting to the party concerned, and has indirectly tolerate the violating to the legal rights of the party concerned. In order to enhance the protection to the legal rights of the civil case corpus, I made a conclusion on the complete definition of the spirit indemnities, which is based on some arguments in the theory field and my own opinions. In this article, I also provide some suggestions to improve the present legislation in our country for everybody to consult.
