On the Defects and Perfecting of "Labor Dispute Mediation and Arbitration Law"

The spirit,idea and basic system of dispute mediation and arbitration are a major reform and innovation,and basically adapt to the market economy under the condition of labor dispute handling requirements and the building of harmonious labor relations.But due to some limited conditions,this new law still has certain outstanding problems and shortcomings,which need further study and resolve.This paper,based on the perspective of law and comparative law,analyzes labor dispute and the concept of the nature of Western countries' labor dispute handling model and its features,and makes a preliminary study on the defects and perfecting of dispute mediation arbitration law.
