Abstract

The purposes of this paper are to analyze the difficulty of recognizing the ownership of collective land in reality and find the solution and propose the corresponding policy recommendation for rural land property right reform in China.Method of demonstration and comprehensive analysis were used.The results show that the keys to recognize the ownership of collective land are that whether the complete rights of disposition and remuneration of collective land is defined,whether the development rights are offered to the collective land owner,whether the land profits can be distributed among different owners and between the collectivity and farmers,and lastly whether the collective land asset can be managed properly and effectively.It is concluded that some measures should be taken,such as(1)the collective organization should be granted more land use autonomy and a comprehensive development planning of collective land use should also be designed;(2)land profits should be distributed properly through land taxation reform;(3)the transfer of collective construction land should be promoted and regulated;(4)the democratic management system of collective economic organization should be improved and the supervision and management of collective asset should be strengthened.
