The main reason for disagreements is that patent can be used to refer to patent right and the patent literature or patented technology on the basis of summarizing the different definition of ineffective patent.In addition,the right to apply for a patent and foreign patent will affect the scientific nature and rationality of the definition of ineffective patent.Public and monopoly is the key to grasp the essence of patent system.All the technologies which have been in public in the patent literature should belong to ineffective patent,if the owner has not the patent in China.
