Abstract

Chinese ancient concept of harmony takesgradation and difference,pure mind with few desiresandharmony of man with natureas its basic spirit.Its essence is to seek a harmony between various classes with the monarch as the center.Being a basic form of law,the Chinese ancient criminal law is inevitably influenced by this harmonious idea.We can say that the Chinese ancient criminal law is institutionalized form of this harmonious idea to some extent and that he harmonious meaning is infiltrated into both criminal legislation and criminal jurisdiction.
