Abstract

Deepening the reform of the state-owned enterprises should be regulated by laws, instead of by the administrative measures or policies.For the purpose of exerting the function of law in the reform of the state-owned enterprises, we must clarify the definition, features, and position of the state-owned enterprises, perfect the framework of concerned laws firstly.We should integrate the current laws and regulations of state-owned enterprises, structure the enterprise law system whose subject is public service enterprise, regulate the state-owned enterprises respectively depending on the different scopes of business, bring it into the enterprise law system which is classified by the types of the enterprises' organization.As regards public service enterprises, the State should legislate about them particularly and control them directly;as regards competitive state-owned enterprises, the State should trade and regulate them as general enterprise.This measure is in favor of concentrating financial resources for the public service, exerting public service enterprises' fundamental functions, making the market competition equal.
