Discussion on the Patterns of Administrative Execution under Present Electric Power Constitution

Since legislation in connection with the power industry of China is lagging behind the reform in the sector, the actual absence of the administrative execution body directly leads to difficult problems in the administrative execution of the power industry. The underlying reason for this is that the governmental departments authorized with administrative execution power in connection with the power industry do not possess enough manpower, material resources and experience that meet the necessity of the related execution work. Based on the analysis on several administrative execution patterns, this paper proposes that the Leading Group for Local Power Facilities (and power energy) Protection and its office should be authorized, via local legislation, to exercise authority of administrative execution related to electric energy and that its office should be set up in the local power companies, thus maximizing the effectiveness of power-related administrative execution.
