Abstract
The purposes of the paper are to figure out key issues of the transfer pattern of the collective land use right and analyze the current legal issues so as to put forward corresponding legislative countermeasures and legal framework.Methods employed are analysis case,comparative study and empirical analysis.The results indicate that 1) mortgaging right of collective land should be allowed;2) inheritance as a legal approach for the transfer of collective land use right is feasible.It is concluded that we should revise the relevant laws,such as the Land Administration Law,the Rural Land Contract Law and the Property Law,etc.
