Abstract
The property right is not a simple logic category but a historical category and it is a reflection of social relationships in a certain historical period.The formation of a system usually originates from the enlightenment of thoughts and the change of a system is also the result of the change in thoughts.In each historical times,property right develops in various ways in totally different relation.If attention is paid to the historical changing process of the legal protection of property right in western capitalist nations,it can be seen clearly that with the development of society and economy,the attitude of law toward private property right has been changing from absolute protection to relative protection.Socialist China has gone through a different way in the legal protection of private property right.
